Terms and Conditions of Sale and Use (T&Cs) and Legal Notices

The terms and expressions below are defined as follows:
Client: refers to any user who places an order and purchases a Product on the Site.
Parties: refers to Nex Group and the Client.
Seller: refers to Nex Group.
Product: refers to all other products offered for sale on this Site.
User: refers to any person who uses the Site.
For the purposes of these terms, any mention of 'Nex Group' also includes 'ZZZ Airsoft', its website, and vice versa, particularly regarding the rights, responsibilities, and obligations defined in this document.

These general terms and conditions of sale apply without restriction or reservation to all online sales offered by Nex Group on the website www.zzz-airsoft.com.
The general terms govern the sale and delivery of products on our website. They define the rights and obligations of both parties. They may be supplemented by specific terms of sale or use for certain Products or services, which complement these general conditions.

The website www.zzz-airsoft.com is published by Nex Group EURL "Entreprise Unipersonnelle à Responsabilité Limitée", registered with the Paris Trade and Companies Register under number 938239829.
ZZZ Airsoft offers a range of products primarily dedicated to airsoft enthusiasts.

Preamble - Acceptance of the Terms and Conditions
The client acknowledges having read, at the time of placing the order, the terms and conditions of sale stated herein, applicable to their purchase, and declares acceptance without reservation. These general terms and conditions of sale govern the contractual relationship between Nex Group and its client, with both parties accepting them unreservedly.

By using our Services, you certify that you are a natural, non-commercial adult acting for personal needs. You are thus presumed to act as a "consumer".
To make a transaction, you must be of legal age (at least 18 years old) and possess the legal capacity to contract under these T&Cs.
We reserve the right to amend our terms of sale at any time. Modifications will apply from their publication on the site.
The version of the terms of sale applicable is the one in effect at the time of placing your order. You are therefore invited to carefully read the applicable terms of sale before placing any order.

Orders
For internet orders on ZZZ Airsoft, Nex Group confirms acceptance of the client's order, subject to stock availability, via the email address provided, once payment is received. Subsequently, an automatic email will be sent with the parcel's tracking number, allowing the Client to track the progress of their order.

Nex Group reserves the right to cancel any order from a client with whom there is a dispute regarding payment for a previous order or any other valid reason.

In accordance with Articles L.111-1 et seq. and L.121-17 of the Consumer Code, the Client acknowledges having been informed of the Products' characteristics.
Nex Group cannot be held responsible for stock shortages or any incidents.

Sale Prices
The Product sale prices, indicated in Euros, are those displayed on the Site at the time of the Buyer’s order.
Prices include the applicable French Value Added Tax (VAT) on the day of the order. Any change in the applicable VAT rate will automatically be reflected in the Prices and charged to the Buyer. The indicated prices are net prices, including the cost of products, packaging, handling, storage, etc.
Prices do not include delivery charges, which are billed separately. Delivery charges are shown to the Buyer before final order confirmation.
The buyer is responsible for any additional costs related to the sale and/or delivery of products, such as customs duties and VAT.
Prices may be changed by the Seller at any time.
Nex Group cannot be held liable for the fraudulent use of payment methods on the Site or for errors caused by the payment system.

Delivery Charges
Delivery charges are automatically calculated and displayed when selecting the delivery method.
The delivery cost varies depending on weight, basket amount, and delivery location.

Delivery
The order is delivered by third-party service providers Colissimo and Chronopost, based on the client's choice.

Products are delivered to the delivery address provided by the Client when placing the order, and the Client agrees to receive the products at the indicated address.
It is the Client's responsibility to verify the accuracy of all entered information before confirming the order. In case of an address error, the Seller cannot be held responsible for the inability to deliver the order, and delivery charges will not be refunded to the Client. The Client may contact ZZZ Airsoft Customer Service to request a delivery address modification before the order is shipped. The Seller cannot be held responsible for uncorrected errors. Re-shipping to the correct address will be billed to the Client.
The order is delivered in one shipment. However, the Seller reserves the right to split the Client’s order into multiple deliveries at no extra cost to the Client.
Important Information:
It is not possible to modify a delivery address once the order is placed or the parcel has been shipped, regardless of the shipping method.
Adding items to an order is not possible.
It is important to provide a valid phone number when placing your order to avoid delays in shipping.

Delivery Conditions and Methods
Delivery is made in the presence of the Client or any person authorized to receive the goods. Delivery takes place at the boundary of the property or condominium.
The Seller is not responsible for delivering the order to anyone other than the Client, even if that person is present at the delivery address provided by the Client when placing the order.
Since delivery is performed by a professional carrier, the delivery location must be accessible to vehicles intended for this purpose. If the location is not accessible, the Client agrees to collect the goods at a pickup point.
The Seller reserves the right to refuse orders with a weight exceeding 5 kg.
For deliveries to the Client’s workplace, the Client must take all necessary precautions to allow the courier to hand over the order.
Once the order is delivered to the address indicated, the Seller has fulfilled its delivery obligation and disclaims any responsibility in the event of loss or theft.
In case of loss or theft after delivery, the Seller cannot be held responsible. It is recommended that the Client ensure the delivery address is secure.
If two delivery attempts to the Client’s home are unsuccessful due to their absence, the order may be canceled and refunded, with the full shipping costs, including the second delivery attempt, deducted.
If the above conditions are not met by the Client, no request for redelivery of the package will be honored.

When the Client modifies the original delivery method using tracking tools provided by the carrier, and this modification results in a delivery method without formal proof of delivery (such as leaving the package in a mailbox, at the door, etc.), Nex Group and therefore ZZZ Airsoft cannot be held responsible in the event of a problem during the delivery of the package.

Consequently, if the goods are not received by the Client, no refund or reshipment will be issued. It is therefore the Client’s responsibility to be aware of the risks associated with changing the delivery method.

Delivery to Pickup Points
In the case of delivery to a pickup point, the Client is notified of the arrival of their package by email.

When collecting the order, the Client must verify the general condition of the package before signing and refuse it if there is visible damage. However, if the merchant at the pickup point refuses to allow the package to be opened, the Client must report the incident within 24–72 hours of receiving the package, by email to Customer Service or by using the website’s contact form. Proof supporting the claim will need to be provided. The Client must include the relevant order number and a detailed description of the condition of the package or the damaged product, accompanied by photos.
Packages are held for 7 to 14 days depending on the pickup location. Packages not collected within this period are returned to the Seller.
The return of the order to the Seller due to the Client’s failure to collect it within the indicated timeframe results in the cancellation and refund of the order. In this case, the return shipping costs are deducted from the refund amount.
If the Client still wishes to obtain their order, they must place a new order. The Client bears the delivery costs for this new order.

Home Delivery
The Client agrees to be present at the delivery address provided when placing the order on the day of delivery.
If the Client is not present at the time of delivery, a delivery notice will be left indicating a new delivery date or information about where the package can be collected.

Upon receipt of the package, the Client must check the condition of the package before signing the delivery note and may refuse any damaged package or product by noting "refused due to damage" on the delivery note. However, if the carrier refuses to allow the Client to open the package, or if the package was delivered to a third party, the Client is invited to report the incident within 24 hours by email to the Seller’s Customer Service or using the website’s contact form. The Client must include the relevant order number and a detailed description of the condition of the package or the damaged product, accompanied by photos.

Delivery Time
Except in exceptional circumstances, unforeseeable events, or actions by third parties, the Seller agrees to meet the delivery times indicated to the Client when the order is placed. Delivery times are calculated in business days, excluding Fridays after 11 a.m., weekends, public holidays, or any vacation periods.

In case of delivery delay, the Seller advises the Client to report the delay by contacting Customer Service to agree on the best solution.
In accordance with the Consumer Law of March 17, 2014, in the event of a delivery delay, the Buyer may require the Seller to deliver the goods within a reasonable time from the first day of delay relative to the delivery date announced by the Seller. The Buyer may notify this by email to contact@zzz-airsoft.com.
The liability of Nex Group cannot be engaged in cases of force majeure, such as strikes, fires, natural disasters, or other similar events (this list is not exhaustive).

Shipping Time
The shipping time is generally 2 business days in France, starting from the receipt of payment for the order. However, this timeframe may be extended by several business days in exceptional circumstances, such as peak activity periods, holidays, vacations, or any other legitimate reason.
Orders placed at the end of the week, including Fridays after 11 a.m., will typically be shipped the following Monday. Orders for bulky products may experience additional shipping delays. The Seller undertakes to do everything possible to ship orders as quickly as possible.

Delivery Dispute Management
In the event of a dispute or incident during delivery, the original packaging must be kept until the issue is resolved. The Client must inform Customer Service by email or using the website’s contact form, providing their order number, a description of the damage, and supporting photos, within 24 hours of delivery.

The Seller’s Customer Service will then contact the Client to establish the necessary steps. Investigations with the postal service regarding package delivery must not exceed 30 days. Beyond this period, refund requests will no longer be considered, even after initiating a claims file.

Returns
We are committed to providing complete satisfaction for all our products. In accordance with Law No. 2014-344 of March 17, 2014, governing online sales, you may return items within 14 days of receiving the order (Article L. 221-18 of the Consumer Code), and you will be fully refunded for the item (shipping costs are non-refundable). However, items must be returned in new condition, in their original unopened packaging, including all gifts, accessories, instructions, etc. Return shipping costs are the Client’s responsibility.

To exercise the right of withdrawal, the buyer must send an email to the following address: contact@zzz-airsoft.com.
Provided the conditions are met, Nex Group commits to refunding the returned items, excluding shipping fees, as quickly as possible. The Client will receive a refund confirmation and will be reimbursed using the same payment method as for the original order. Refunds will be processed within a maximum of 14 days after receipt of the returned product, depending on the payment method or the Client’s bank.

Nex Group strongly advises the Client to insure the package, as Nex Group and ZZZ-Airsoft cannot be held responsible for loss or issues with the package during delivery.
If the conditions are not met, the Client must not proceed with returning the package as it will not be refunded. If the package is still returned, the Client must cover the shipping fees for ZZZ-Airsoft to return the package to them.

Products purchased on the ZZZ-Airsoft website must be used appropriately and in accordance with their intended purpose.

Payment and Privacy Policy
Protecting your personal data is our top priority.

Payment for products and services is made by credit card, subject to necessary verifications, in a secure payment space ensuring total protection of the buyer’s data. Transactions are handled via a secure payment service provider such as PayPal, Stripe, etc. Thus, the Client’s payment information is not stored on the website and can only be viewed in encrypted form, ensuring total confidentiality of personal data transmitted online.

Nex Group retains ownership of delivered products until full payment of the amounts due. In the event of a final payment failure, Nex Group reserves the right to reclaim the products by all available means.

Nex Group strictly adheres to Law No. 78-17 of January 6, 1978, on data processing, files, and individual liberties, regarding personal information provided as part of an order placed on our website.
Personal data collected during newsletter registration, comments (including photos and videos), or account creation is used to identify the authors. Unless authorized by you, your personal data will not be shared with third parties. This data is used exclusively for internal statistical purposes to improve the quality of our services.

As stipulated in Article 34 of the “Informatique et Libertés” law of January 6, 1978, you have the right to access, modify, rectify, and delete your personal data. You can exercise this right by contacting us via the contact form.
The collection and automated processing of personal and identifiable information and the recipients of this data have been defined, declared, and authorized by the CNIL (French Data Protection Authority). Declaration No. 1124640.
